DHS Omits Describing H-1B Data Undermining Premise Of Immigration Rule

The Department of Homeland Security (DHS) has been criticized for omitting key data from its proposed immigration rule related to H-1B visas. A technical appendix, not described in the notice of proposed rulemaking, reportedly showed filings for new H-1B “cap” cases fell by more than 91% at consulates after a $100,000 fee was imposed in September 2025. The omission is viewed as undermining the rule’s premise that a new $103,265 fee would raise revenue without deterring employers. Vice President JD Vance’s comments, alongside a prior federal judge ruling striking down the $100,000 fee, suggest the broader aim may be to curb H-1B use.
