Terms of Service

Welcome to xCruzo. These Terms of Service ("Terms") govern your use of the xCruzo mobile application, website (www.xcruzo.com), and all related services (collectively, the "Service") operated by xCruzo LLC ("xCruzo," "we," "us," or "our"), a company headquartered in Weston, Florida, United States.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old to use xCruzo. Users in jurisdictions where applicable law requires a higher minimum age of digital consent — including members of the European Union where the minimum age may be 14, 15, or 16 depending on the member state — must meet that higher requirement. By using the Service, you represent that you meet all applicable age requirements in your jurisdiction. If you are under 16 years of age and located in the European Union, you represent that you have obtained parental or guardian consent to use the Service. xCruzo does not knowingly collect personal data from users who do not meet these age requirements.

2. Account Registration

To access certain features, you must create an account by providing a valid email address, username, and password. You may optionally provide a phone number. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

3. SMS/Text Messaging Terms

By providing your phone number and selecting "Confirm via SMS" during registration, you expressly consent to receive transactional text messages from xCruzo. These messages are used solely for account verification purposes (one-time passcodes).

4. Acceptable Use

You agree not to: (a) use the Service for unlawful purposes; (b) attempt to gain unauthorized access to any part of the Service; (c) interfere with or disrupt the Service; (d) scrape, crawl, or harvest data from the Service without authorization; (e) impersonate another person or entity.

5. News Content

xCruzo aggregates and summarizes news from third-party sources using artificial intelligence. We do not claim ownership of third-party content. AI-generated summaries are provided for informational purposes only and may contain inaccuracies. Always refer to the original source for verification.

xCruzo does not take editorial positions on political, religious, social, or other matters of personal opinion. Our AI-powered curation and summarization tools present news content in a neutral and informational manner. xCruzo does not endorse, promote, or suppress any particular viewpoint, ideology, religion, political party, candidate, or belief system, and does not discriminate in the selection or presentation of news content based on origin, identity, or affiliation.

Vehicle information provided through our VIN Search feature — including MSRP, specifications, and xCruzoAi scores — is sourced from publicly available databases and proprietary algorithms. This data is provided "as is" for informational purposes only and does not constitute an appraisal, guarantee of condition, or substitute for a professional vehicle inspection.

Prices, values, and market estimates displayed in xCruzo reports — including MSRP, market value ranges, and pricing confidence scores — reflect data available at the time the report was generated and are subject to change without notice. These figures do not represent a guarantee, commitment, or offer of any kind. xCruzo is not a vehicle dealer, broker, or financial advisor, and is not involved in the sale, purchase, financing, or negotiation of any vehicle transaction. Always verify current pricing, final transaction terms, applicable taxes, fees, and any other charges directly with the seller, dealer, or a licensed professional before making any purchasing decision.

7. Intellectual Property

All content, trademarks, logos, and software associated with xCruzo (including the xCruzoAi brand) are the property of xCruzo LLC. You may not reproduce, distribute, or create derivative works without prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. xCruzo does not warrant that the Service will be uninterrupted, error-free, or that any information provided (including AI summaries, vehicle data, and scores) is accurate, complete, or reliable.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, xCruzo LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO RELIANCE ON VEHICLE DATA, AI SUMMARIES, OR SCORES.

11. Indemnification

You agree to indemnify and hold harmless xCruzo LLC, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Modifications

We may update these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Termination

We reserve the right to suspend or terminate your account at our sole discretion, with or without notice, for conduct that violates these Terms or is otherwise harmful to the Service or other users.

14. Governing Law

xCruzo LLC is a limited liability company organized and existing under the laws of the State of Delaware (File No. 10251768). These Terms are governed by the laws of the State of Florida, United States, where xCruzo LLC maintains its principal place of business, without regard to conflict of law provisions. Any dispute arising out of or related to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Broward County, Florida, and you hereby consent to the personal jurisdiction of such courts.
