Who can sell '6 7' chicken nuggets? One company is asking a court to decide

A court fight over “6 7” chicken nuggets has Perdue Foods asking judges to decide who can profit from the trend. Perdue sued Soules Foods in federal court in Virginia, alleging Soules copied the core visual concept of Perdue’s “6 7 Chicken Nuggets,” which debuted in April and reached nationwide sales at Walmart by May. Perdue’s frozen, breaded nuggets are shaped like the numerals 6 and 7, and its packaging shows two cupped hands beneath the digits on a doodle-filled background with a smiley face. Soules announced on June 7 that it would sell its own breaded 6-and-7 nuggets nationwide at Kroger and Aldi in July, using similar packaging elements including cartoon hands and doodle-style visuals. Perdue seeks a preliminary and permanent injunction, plus a recall and destruction of packaging and ads. Trademark applications for “6 7” and the hand placement are pending.
