DOJ's Antitrust Division remains interested in your private litigation

Since the start of the second Trump Administration, the U.S. Department of Justice’s Antitrust Division has filed 21 statements of interest in ongoing private litigation where it is not a party. The DOJ uses the discretionary filings—similar to an amicus brief, but before a trial court—to signal potential enforcement priorities and influence how courts handle issues. Acting Assistant Attorney General Omeed Assefi highlighted the program’s activity in a March 2026 speech at George Washington Law School, citing a record day with three statements. After Assefi left, Associate Attorney General Stanley Woodward signed the latest submissions. The DOJ has filed at least five statements each year since 2018, with limited exceptions.
