BBNJ: Collection of marine genetic resources in areas beyond national jurisdiction

The UK’s Biodiversity Beyond National Jurisdiction Act 2026 sets out what qualifies as “collection” of marine genetic resources from areas beyond national jurisdiction, and when reporting rules apply. The guidance states that the collection requirements apply to a collection project where a UK craft is used to collect resources beyond national jurisdiction after 9 August 2026, following the Agreement’s entry into force for the UK. It explains that “collecting” includes targeted sampling—such as marine scientific research or commercial bioprospecting—and also certain non-removal sampling where data is extracted. Exceptions include fishing, fishing-related activities, and activities in Antarctica. The act can cover collectors using UK-registered ships and other qualifying UK-linked vessels, but not ships registered in UK Overseas Territories or Crown Dependencies.
