Appeals court skeptical of bid to curtail abortion pill access
xCruzo Brief
A U.S. appeals court panel on Wednesday signaled skepticism about Louisiana’s effort to restrict access to mifepristone, arguing it could undermine the state’s abortion ban framework. The Republican-led state asked the 5th U.S. Circuit Court of Appeals, based in New Orleans, to block a 2023 FDA rule that enabled telemedicine prescribing and nationwide mail delivery. Louisiana Solicitor General Ben Aguinaga said the state is seeing about 1,000 abortions a month linked to mailed mifepristone. Judges—including Stephen Higginson—questioned whether Louisiana had legal standing and whether the rule caused those abortions. The Supreme Court lifted a prior block in May, allowing the access pathway to continue.
