Supreme Court upholds state bans on transgender athletes in girls’ and women’s sports, allowing states to restrict participation based on biological sex. On Tuesday, the Court ruled states may enforce eligibility requirements grounded in Title IX and the Equal Protection Clause, in two closely watched cases: West Virginia v. B.P.J. and Little v. Hecox. The majority opinion, written by Justice Brett Kavanaugh, said the Constitution and Title IX do not require an overhaul of women’s and girls’ sports nationally. The decision preserves similar rules in 27 states, including West Virginia’s “Save Women’s Sports Act,” enacted in 2021. The NCAA and the International Olympic Committee have also tightened eligibility so women’s events are limited to athletes assigned female at birth.
